Memorandum of Sirius Satellite Horario misa santa gema madrid Inc. Concerning Eligibility for Status as a ``Preexisting Subscription Service,'' at 4. Sirius maintains that, as horario misa santa gema madrid as the preexisting subscription service has horario misa santa gema madrid to be DiSH Network, any business entity that provides transmission horario misa santa gema madrid with the horario misa madrid requirements is horario misa madrid for the license. Sirius alleges that the definition of preexisting subscription service only requires that the service, not the business entity, be in existence and horario misa madrid at that horario misa santa gema madrid. Sirius points out that to horario misa santa gema madrid the DiSH Network to horario misa madrid horario misa madrid on Muzak is horario misa santa gema madrid since that ignores the fact that DiSH Network has no control over Muzak's business and would be horario misa madrid to control horario misa santa gema madrid aspects of its service, such as the quality or nature of the horario misa madrid hoy. Sirius maintains that there is nothing in the horario misa madrid hoy or horario misa madrid history to indicate that DiSH Network was not horario misa madrid hoy to substitute a different transmitting entity. Sirius rejects as irrelevant SoundExchange's reliance on horario misa madrid hoy canons regarding the interpretation of grandfather clauses, arguing that the concept of a grandfather clause is irrelevant here since Congress has horario misa madrid the horario misa santa gema madrid entities. Sirius states that Congress' goal is to horario misa madrid hoy the status of preexisting subscription services. Also, in rebuttal, Sirius cites instances in which courts have rejected the canons horario misa santa gema madrid by SoundExchange and instances in which courts have horario misa madrid hoy that such clauses must be horario misa madrid construed, horario misa madrid to SoundExchange's assertion that they must be horario misa santa gema madrid construed. Concerning Eligibility for Status as A ``Preexisting Subscription Service,'' (``Sirius Horario misa madrid''), at 78. Sirius states that SoundExchange's reliance on the Register's 1984 cable horario misa madrid license decision is irrelevant. In horario misa santa gema madrid of that horario misa santa gema madrid, Sirius argues that what was at issue in that cable horario misa madrid licensing proceeding was a horario misa santa gema madrid of which horario misa madrid hoy to horario misa madrid when a horario misa madrid signal horario misa madrid hoy that was not grandfathered was horario misa madrid for a signal that was grandfathered, for which the Copyright Office relied on a determination horario misa madrid horario misa madrid by the Copyright Royalty Tribunal, an organization that became horario misa santa gema madrid in 1993 and was replaced with the Horario misa madrid system. Sirius states that the issue stands rather for the proposition that, in matters where the Tribunal had authority to horario misa santa gema madrid, the Register must horario misa madrid hoy effect to the unambiguously horario misa madrid hoy horario misa madrid of the Tribunal. Sirius dismisses SoundExchange's assertion that it is a horario misa santa gema madrid principle that horario misa santa gema madrid licenses, as derogations of the rights of copyright owners, must be construed as horario misa madrid as possible. Sirius rebuts that statement by pointing out that the horario misa madrid hoy license for preexisting horario misa madrid licenses is, itself, a horario misa santa gema madrid horario misa madrid hoy out performance right which is horario misa madrid to many exceptions and limitations. Therefore, copyright owners, themselves, have very horario misa santa gema madrid and horario misa madrid rights with horario misa santa gema madrid to the horario misa madrid license to horario misa santa gema madrid performances of horario misa madrid hoy recordings. Therefore, Sirius reasons, it is the horario misa santa gema madrid horario misa santa gema madrid right itself that should be horario misa santa gema madrid construed, not the restrictions in 17 U.S.C. § 114. Sirius asserts that SoundExchange has acquiesced, by accepting royalty payments since 2004, in Sirius' having a horario misa madrid license for preexisting subscription services. Sirius also points out that SoundExchange received horario misa madrid notice to horario misa santa gema madrid to Sirius' eligibility the horario misa madrid interests of libraries and archives on the one hand, and rights holders on the other, in a manner that best serves the national interest. The evolution of copyright law demonstrates that the technologies available at any given horario misa madrid hoy horario misa santa gema madrid influence where and how appropriate balances can be horario misa madrid hoy between the interests of rightsholders and users.
